Alexis Avila, 18, allegedly put her newborn baby in the trash.

Alexis Avila is a teenager accused of dumping her newborn baby in a trash can in the city New Mexico. The baby was given emergency treatment and treated at the hospital.

Police said the 18-year-old woman was arrest and faces charges of attempted murder and child abuse. Investigators were able to identify Avila in part thanks to surveillance footage from a nearby retail store.

Police have scheduled a press conference for January 10 at 4:30 p.m. ET to share updates on the case. This post will be updated.

1. Police Say Avila Admitted To Giving Birth And She Was ‘Frightened’

Avila has confessed to throwing her newborn baby in the trash, according to Hobbs . Police Department. Officers said Avila admitted she gave birth “in a different location” before driving to the parking lot, where she said she abandoned the infant.

Avila told police she didn’t realize she was pregnant until the day before she gave birth at her parents’ home, according to an arrest warrant cited by KLBK-TV.

“Alexis explained that she was panicking and didn’t know what to do or who to call after the incident. She then claimed that she cut the umbilical cord, wrapped the baby in a towel and placed the baby in a trash bag before she started ‘driving around’, KLBK-TV reported, command quote.

Police were called to the 1400 block of North Thorp Street around 8pm on January 7. The baby was treated at the scene by Hobbs EMS before being taken to Lubbock Hospital for further treatment.

Police said the child was stable as of January 9. They did not provide further details about the specific injuries, how long the child is expected to stay in hospital, or who will care for the child. baby after being released.

2. Baby has been in the Dumpster for about 6 hours

The trash can is located behind a Rig Outfitters store, equipped with surveillance cameras. Store owner Joe Imbriale shared the surveillance video with police and uploaded part of it online. The video does NOT include any images of babies.

First video has a timestamp of 2pm local time. The woman, whom police believe to be Avila, was driving a white car with three people in it. She got out of the car, grabbed a black trash bag from the backseat, and threw it in the trash to open it.

From the footage alone, it is impossible to see what was in the bag that Avila put in the trash. Police said Avila admitted it was her infant.

Due to timestamps on surveillance video, police knew the baby had been in the trash for nearly six hours, NBC affiliate KOB-TV reported.

3. Strangers find the baby and call 911

Additional surveillance footage, shared with KOB-TV and KOAT-TV, revealed that three people looking through the dumpster late that evening rescued the baby. Imbriale told KOAT-TV that it was fortunate that “sea divers” were there that night. The video does NOT include any close-ups of babies.

The team pulled out the trash bag and found the baby at 7:42 pm. A woman is recorded caring for a newborn while one of the men calls 911, KOB-TV reported.

They got into a truck and moved it near the street. Emergency responders arrived 8 minutes later.

4. Imbriale has started a GoFundMe campaign for kids

Imbriale has started a GoFundMe . page for the benefit of the baby. He wrote on the site that the goal of the campaign was “to be able to show this baby that she is cared for by our community”.

I said KOB-TV he didn’t know what was going on until an officer asked about getting footage from his surveillance camera. “I said ‘what are we looking for,’ and she said, ‘we’re looking for someone who threw a bag of black trash in your trash.’ I turned around, I said ‘please don’t tell me it’s a baby,'” Imbriale told the broadcaster.

Imbriale added: ‘I couldn’t sleep at night knowing that this baby had just been thrown in such a trash can. “I’m sorry but who did that? That is evil. I have no words for it. ”

5. New Mexico Has Safe Haven Law in effect

Avila’s case is being heard in the Lea County District Court, police said. She faces charges of attempted murder and child abuse, both first-degree charges.

Avila doesn’t seem to be in custody as of Jan. 10. She’s not on the list List of prisoners of Lea . County and her name doesn’t appear on Vinelink.

New Mexico has Safe Haven Law effective. Follow law, Avila may have abandoned the infant at the hospital. As long as the baby is not being abused, no questions will be asked:

A. A person can leave a newborn baby with employees of a safe haven without criminal prosecution for abandonment or abuse if the child is born within ninety days of from being left in a safe haven, as determined to a reasonable degree of medical certainty, and if the infant is abandoned in a condition that does not constitute neglect or abuse child use pursuant to Section 30-6-1 NMSA 1978.

B. A safe haven may require the person who left the infant the name of the infant’s biological father or mother, the name of the infant, and the infant’s medical history, but the person leaving the infant The student is not required to provide that information to the shelter-in-place safe.
