The District Attorney of Albany County, New York, announced Tuesday that his office has dropped the misdemeanor case. Finally, District Attorney David Soares (D) said Tuesday that his office does not think it can prove Cuomo guilty of the forcible touching.

“While we have found the complainant in this case to be cooperative and trustworthy, after reviewing all available evidence, we have concluded that we cannot meet the burden of himself on trial,” he said. “As such, we have notified the Court that we refuse to prosecute this matter and request the dismissal of the charges filed by the Albany County Sheriff.”

The misdemeanor case was tense from the start, with reports that the sheriff’s office complaint appeared to be obscured. both DA and Commissa office.
