Beachgoers from South Australia films a couple having sex on Henley Beach in broad daylight

A couple have apologized after they were filmed having sex on the beach in broad daylight – but police say the man who filmed the couple may be the one in hot water.

The couple’s public declaration of love took place on Monday afternoon in front of other beachgoers, including several children, at Henley Beach in South Australia.

A man who saw the couple recorded the intimate act on his phone.

“Hey, look at this,” he says to another person while filming the couple.

“He makes the anaconda!”

The man then confronted the couple and accused them of “public indecency in front of children”.

He tells the man who was filmed: “Sorry. Say you’re sorry.’

“Yes, sorry,” the man replies.

At another point during the commotion, the man who took in the couple again demands an apology.

“No, I want you to say you’re sorry,” he says.

“Yes, I’m 100 percent sorry I’m doing this in front of children,” the man replies.

Footage of the intimate act was uploaded to Facebook and viewed thousands of times.

It was removed from the social media platform on Monday evening.

South Australia Police are aware of the incident but are not filing charges at this time.

They claim that the man who filmed the couple might actually be breaking privacy laws.

This has been backed by some legal experts who claim he could get in trouble.

“It’s not a slap on the wrist, but some of these offenses carry the prospect of imprisonment and while unlikely, it’s certainly a possible sentencing option for the court,” Woods and Co’s attorney Hugh Woods told 7News.

In South Australia it is a criminal offense to be involved in demeaning or degrading films, or to take and share a sexual or intimate image of someone with their consent.
