A 44-year-old man in Florida was arrested this week after allegedly firing multiple shots at a naked man he found sleeping in his teenage daughter’s bed after a night of drinking. Dayne Victor Miller was taken into custody on Wednesday and charged with two counts of aggravated assault with a deadly weapon and a gunshot into an occupied apartment, authorities said.
According to a press release from the Cape Coral Police Department, officers responded to an 911 call at approximately 12:32 am on March 8 at an apartment building on the 1000 block of SW 1st Street regarding a reported shooting incident. In the call notes, the dispatcher wrote that the caller, later identified as Miller, “shot at two people in his home through a bedroom door.”
“Mr. Miller called dispatchers and said that one of his roommates was naked in his teenage daughter’s bedroom, prompting him to shoot at both roommates through a closed bedroom door,” the press release said.
When first responders arrived at the scene, they were able to get both of Miller’s roommates out of the bedroom.
Investigators learned that the two victims were a married couple who rented a bedroom in Miller’s home. Miller’s wife and teenage daughter also lived in the home.
Officials at the scene said they found “shell casings and bullet holes through the victims’ bedroom door,” according to the press release
Miller told investigators that earlier in the night he and the two victims “drank heavily.” He was then escorted out of the house without incident and arrested.
In an interview with investigators earlier in the night, the two victims also “said they had been drinking excessively.” The previously naked man told police that at some point during the night he got out of bed to use the toilet and then “went into the bedroom of the teenage girl who lives in that location by mistake and slept in the bed”. so the publication states.
When the teenager noticed a naked man lying in her bed, she went to her father and told him what had happened. Police say the young girl “did not claim any crime was committed against her” as the man lay in her bed.
Police say the naked man’s wife woke him up and “yelled that the room the victim was in was not their room they shared.”
“When they returned to their room, Mr. Miller approached their bedroom and began banging on the door, yelling, ‘I’ll kill you,’ after the door was closed and locked on him,” the press release reads . “At that time, in a rage, Mr. Miller shot his pistol three or four times at the floor outside the bedroom door.”
After his incarceration, Miller was committed to the Lee County Jail, where he is currently being held. Jail records show his bail had not been set as of Thursday morning. He is scheduled to appear in court on April 10 for his indictment.
