A defendant in the US Capitol attack is now accused of plotting to kill law enforcement officials investigating him. Tennessee man Edward Kelly, 33, has company in criminal court. indicted by federal prosecutors Austin Carter, 26, as a co-defendant. For example, Kelley wanted to attack the FBI field office in Knoxville, Tennessee, investigators said.

A third person is said to have reported to the authorities and agreed to make secret recordings. From documents from Friday:

On December 14, 2022, at approximately 3:45 p.m., Witness 1 had a recorded call with KELLEY through Service 1. KELLEY began the call by saying, “I just texted Austin [CARTER] a message, here’s your course of action: If I’m extradited to DC or you don’t hear of my status within 24 or 48 hours of my status when they come to arrest me again, start with that. You perform them in her office. What you and Austin [CARTER] You need to recruit, call, as many as you can [UI] who you need and you will attack their office. If the same thing happens to any of you, I’ll do the same, okay?” Witness 1 replied, “Just to make sure I understand which office we’re after the Knox office, right?” KELLEY replied, “yes”. KELLEY further said to WITNESS 1, “Once you have enough people… you don’t have time to train or coordinate, but every punch has to hurt, every punch has to hurt.”

Charges against Kelley and Carter include conspiracy, retaliation against a federal agent, interstate communication of a threat, and encouragement to commit a violent crime.

All of this stemmed from the fact that Kelley was allegedly among Trump supporters who stormed the US Capitol building on Jan. 6, 2021 to block Congress from certifying it Joe Bidens Victory in 2020 election. Federal authorities said he — wearing a gas mask, green tactical helmet and backpack strapped across his chest — smashed a window of the building with a wooden plank, authorities said. He allegedly entered and kicked open a door to let in other rioters. Investigators also say he and two other men got into an altercation with a Capitol Police officer and threw the officer to the ground.

Kelley was among the rioters who followed the Capitol Police Officer Eugene Gutman up a flight of stairs and he spoke to him, authorities said. Goodman was credited with leading the angry rioters away from the direction of the Senate chambers.

Kelley was arrested in May of this year. From there, things reportedly escalated to him plans to take out the law enforcement officers investigating him. He, Carter and a witness took a walk through Jarvis Park in Maryville, Tennessee on December 3. Kelley reportedly issued a statement, “since we’re such a small group, we’ll be doing mostly reconnaissance missions and assassination missions.”

“I don’t have the list now, but I’ll get the list to you later,” he said, according to documents.

Kelley urged Carter and the witness to get information about the people on the list and asked the witness to “contact your cop buddies” to dig up information about those people, authorities said. On Tuesday, Carter and the witness were at their place of work when Carter gave the witness an envelope containing “the list” and a thumb drive, documents say.

“The envelope contained a printed document entitled ‘The List,’ with approximately thirty-seven names, positions and some phone numbers of law enforcement personnel involved in the criminal investigation into KELLEY,” court documents said. “The list specifically identified which law enforcement officers were present on May 5, 2022 ‘at the arrest or search of KELLEY’s home.’ The list appears to be a computer generated Word document. Additionally, the envelope contained a USB drive with what appeared to be video footage from KELLEY’s home security camera from the morning of the search of KELLEY’s home on May 5, 2022, showing at least one police officer approaching KELLEY’s home.”

The witness came before investigators with that evidence, authorities said.

Kelley’s prosecutor did not immediately respond to a Law&Crime request for comment.
