Judge says video of men laughing “callously” at LSU sophomore girl Maddi Brooks is evidence of a felony

A judge has ruled video footage of a drunk sorority being filmed of their alleged rapist is evidence a crime took place – just days after lawyers argued it would exonerate them.

Madi Brooks, 19, died after being hit by a ride-along car at 3am on January 15 when she was being dropped off by four men who were picking her up at a college bar.

The LSU Alpha Phi member was seen “stumbling drunk” into a car with the group before her death, with police claiming she was anally raped by two of them while two others looked on.

A 17-year-old boy who could not be identified was charged with third-degree rape along with Kaivon Washington, 18.

Washington’s uncle Everett Lee, 28, and his friend Casen Carver, 18, were also arrested and charged as accomplices in the third-degree rape following the student’s death.

Judge Brad Myers told the court Tuesday he viewed video shot by Washington after the alleged attack took place.

He said the video showed the suspects laughing “callously” as she slurred her words in the car, but it didn’t show the attack.

Myers told the court “the evidence to me is clear,” adding it was evident that a crime had been committed before Madi’s death.

Attorney Ron Haley, representing Washington in the case, argued before appearing in court what happened to Madi was a “tragedy but definitely not a crime.”

He also claimed that there was an argument and she got out of the car, saying the men “didn’t drop her off at the curb”.

But Myers said the video proved there was evidence of a crime against the 19-year-old. Prosecutor Stuart Theiror said at the hearing that the state is seeking an enhanced charge of first-degree rape and plans to convene a grand jury in the case.

Louisiana’s first-degree rape law carries a mandatory life sentence with no possibility of parole.

The three adults turned themselves in to the police on Sunday, and the teenager reported on Monday.

The court also looked at surveillance footage around Reggie’s bar, where the group met, which police documents say shows Madi drunk and stumbling around.

All three adult suspects appeared in court via video link and were ordered to remain under house arrest and wear shackles.

Carver is being held on a $50,000 bond, Lee on a $75,000 bond, and Washington on a $150,000 bond.

They claim she was in a “drunk state” but was able to agree and willingly got in the car with them before dropping her off at the curb.

Legal documents viewed by DailyMail.com show Madi had 0.319g per cent alcohol in her system – so high that toxicologists said she could have suffered from alcohol poisoning or passed out.

Third-degree rape charges in Louisiana relate to a victim being unable to consent because she is under the influence of alcohol or drugs and the perpetrator “knew or should have known of the victim’s incompetence.”

Carver said he was “uncomfortable” during the sex acts and he “hated it,” adding that he thought she was too drunk to agree

Shocking incidents at LSU bar Reggie’s where Madi Brooks was last seen

Reggie’s Bar, a notorious Baton Rouge venue known for its drinking and underage violence, had its liquor license suspended again following the death of 19-year-old Madi Brooks.

Bar owner Darin Adams, whose sports bar is known for its stuffed animal heads and Confederate flag decor, has declined to comment.

Adams was in hot water before when Baton Rouge police raided the bar and suspended its license for 45 days in July 2017 after 37 people were arrested – many of them on charges of underage drinking.

In September 2015, a drunk 21-year-old was arrested for pointing a loaded gun at people and threatening to open fire.

The following month, a 19-year-old man was charged with rape after assaulting a drunk woman who had been separated from her sister in the bar and was trying to find her way home.

And in January 2016, a star of the LSU football team, Dillon Gordon, 22, was stabbed multiple times in the bar.

In May 2022, 16-year-old Carltez Tucker was shot and killed outside Reggie’s and a 24-year-old woman was injured. Detectives arrested three and said they believed the shooting resulted from a stolen firearm that Tucker took.

Police say she was so drunk she could not have consented to the sexual activity, and Carver told police he “hated” what his friends had done to Madi because she was “more drunk” and “disabled.”

An autopsy also revealed that there were traces of THC or cannabis in her system at the time of her death.

The Louisiana ATC has confirmed that they have suspended Reggie’s Bar’s license due to the “seriousness of the allegations and the potential threat to public safety.”

In a statement, they confirmed they are working with law enforcement and citing “recent incidents” at the facility – with a hearing set to be set for next month.

An attorney for the Bar, Kris Perrett, confirmed in a statement that they are “fully cooperating with the authorities.”

It comes after DailyMail.com revealed Madi appeared to be working at the bar where she met the group – and a TikTok video showed the wild antics of the minors inside.

Authorities also seized surveillance footage from the bar and nearby businesses, showing Madi arriving at the bar at 10:06 p.m., while Carver, Lee, Washington and the teenager arrive at 10:18 p.m.

Officials say in their affidavit that Madi was seen at 1am sitting on a stool by the counter at the bar before tripping and getting to her feet with the men’s help.

At 1:34 am, she was seen sitting on a bench by the front door before falling again as the teenager approached her, took off her cap and helped her to her feet.

The group was seen exiting the bar at 1.49am with the vehicle last seen at 1.59am. Carver told police the 17-year-old and Washington both had sex with the victim in the back seat of the car.

Madi was dropped off less than a 10-minute drive from the bar before being hit by the ride-along car at 2:50 a.m.

Carver, who was driving the vehicle, told police he asked Madi where her friends were but she said she didn’t know and was “drunk”.

Her sorority wrote on Monday: “Madi was a vibrant, loving and selfless friend. She left an indelible mark on our chapter, we cherish our memories together and we will never forget them. Our forever friend was a hero too, Madi donated her heart and kidneys to save the lives of others.

Reggie’s in Baton Rouge has now had its liquor license suspended by the Louisiana ATC in an “emergency.”

He added that Madi gave the 17-year-old “five oral consents” before having sex with her in the back of the car, with Washington getting out of the vehicle before swapping places with the teenager to also have sex with the victim .

During his police interview, Carver denied ever seeing or knowing Madi before, but agreed to take her with him.

Both Carver and Lee stayed in front of the car while the sexual acts were performed, with Carver telling them to “stop” before dropping Madi off.

A post-mortem revealed that Madi had “injuries related to previous anal sexual assault” as well as her injuries from the crash.

The fatal accident was the second collision on Burbank Drive that raised questions about the safety of the area.

Ethel Wesly, 71, was killed the same week, with locals arguing there needed to be more lighting, sidewalks and a lower speed limit.

More lighting is also planned for the entrance to the Pelican Lakes subdivision in Burbank, where Madi was killed.
